Terms and Conditions

(1) CANCELLATIONS

Born as the Earth Zen Academy (BEZA NPC.) reserves the right to cancel any booking forthwith and without liability on its part in the event of any damage or destruction of the venue by fire, water, or any other cause, any shortage of labour or food supplies, strikes, lockouts or industrial unrest, or any cause beyond our control which shall prevent BEZA NPC. from performing its obligations in connection with any bookings. BEZA NPC. will issue a 100% refund or credit (valid for 12 months from date of issue and subject to accommodation availability) for all cancellations initiated by us.

(1.1) CREDIT AND REFUND POLICY – RETREAT GUESTS AND PARTICIPANTS

BEZA NPC. will provide all guests and participants with a 100% credit (valid for 12 months from date of issue and subject to accommodation availability) for all cancellations initiated by retreat guests and participants. Should you require a refund the following terms apply:

  • Cancellations received less than 10 days in advance – No refund (yet option for credit still applies).
  • Cancellations received less than 30 days in advance – 50% refund
  • Cancellations received more than 30 days in advance – full refund minus a R200 administration fee

(1.2) INDEMNITY & WARRANTIES

Guests/Apprentices/Students shall hold blameless and indemnify BEZA NPC., its teachers, facilitators, community, directors/members, officers, employees, agents, independent contractors, representatives, subsidiaries, affiliates, controlling or holding companies and insurers past and present (“The Indemnified Parties”) who shall not be liable or responsible for any personal injury, harm, death, loss of support or any other damages of any nature whatsoever whether arising from negligence or any other cause whatsoever.

(1.3) INDEMNITY & WARRANTIES

Teachers/Facilitators shall hold blameless and indemnify BEZA NPC. its teachers, facilitators, community, directors, members, officers, employees, agents, independent contractors, representatives, subsidiaries, affiliates, controlling or holding companies and insurers past and present (“The Indemnified Parties”) who shall not be liable or responsible for any personal injury, harm, death, loss of support or any other damages of any nature whatsoever in respect of either the Teacher or the Participant, whether arising from negligence or any other cause whatsoever. The Teacher, Facilitator, or Organiser of a Retreat or Event, warrants that s/he has the necessary event and personal liability Insurance.

(2) DEFINITIONS

Teacher(s)/Facilitators shall mean any person hosting or facilitating a retreat or workshop or organizing or leading a person/s for an event through BEZA NPC.

Participant(s)/Client(s)/Guest(s)Apprentice(s)/Student(s) shall mean any person attending a retreat or workshop or event, booking a personal retreat, or engaging services offered by BEZA NPC..

Days shall mean calendar days and months shall mean calendar months.

(3) MINISTRY and WELL-BEING SERVICE

BEZA NPC. offers Health and Well-Being Education and ministry/minister services in the spirituality health & wellness, sustainability and education sector, and retreat services to Teachers, Participants, Organizers, and Guests.

(4) DELIVERY POLICY

Subject to availability and receipt of payment, requests will be processed within 10 days and delivery confirmed by way of a Registration ID.

(5) CLIENT PRIVACY NOTICE STATEMENT

BEZA NPC. shall take all reasonable steps to protect the personal information of Clients. We commit to comply with the requirements of relevant Data Privacy and Protection Laws and Regulations and to process your information in a safe and responsible manner.

(6) PAYMENT OPTIONS ACCEPTED

Payment may be made via Visa, MasterCard, Diners or American Express Cards or into the bank account of BEZA NPC. (bank details provided on request).

(7) INTEREST

Interest will be charged at prime, as charged by First National Bank at the applicable time, plus 2% per month or part thereof for any amounts outstanding.

(8.1) CARD ACQUIRING AND SECURITY

Card transactions will be acquired for BEZA NPC. via PayFast (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayFast uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

(8.2) CLIENT DETAILS SEPARATE FROM CARD DETAILS

Client details will be stored by Born as the Earth School / Glenn G. Leisching separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to https://payfast.io/.

(9)  MERCHANT OUTLET COUNTRY AND TRANSACTION CURRENCY

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

 (10) RESPONSIBILITY

BEZA NPC. takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

(11) COUNTRY OF DOMICILE

This agreement is governed by the laws of South Africa and BEZA NPC.chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature:

(12) VARIATION

BEZA NPC. may, in its sole discretion, change this agreement or any part thereof at any time without providing notice thereof.

The Teacher, Facilitator, or Organizer of a Retreat or Event, warrants that s/he has the necessary event and personal liability Insurance. 

RIGHT OF ADMISSION RESERVED

Please note:

We do not allow persons under the age of 18 to attend our classes/curriculums/retreats, unless with prior consent.

We do not allow pets at in-person retreats/gatherings.

We do not allow alcohol or recreational drugs at in-person retreats/gatherings.
